12.5 Terms & Conditions

These Terms & Conditions govern all Buyer’s Agent services provided by Next Fit LLC in Mexico, the U.S., and Canada. By purchasing a Silver or Gold Package, you agree to these terms.

1. Service Scope

• Our role is to act exclusively as Buyer’s Agent, representing your interests throughout the acquisition process.

• We provide impartial property search services across all available channels — including other agencies, developers, and off-market opportunities.

• We do not promote or push specific listings to increase commissions.

2. Packages & Duration

• Silver Package: Includes 8–10 curated property proposals and accompaniment for 3 property visits, valid for 4 weeks from Day 0 (the day your curated property report is delivered).

• Gold Package: Includes 15–18 curated property proposals and accompaniment for 8 property visits, valid for 10 weeks from Day 0.

• The stated duration applies to Steps 6–8 of our 10-Step Process (visits, inspections, negotiations). The service continues until closing with the notary (Mexico) or title company (U.S./Canada) once an offer is accepted.

3. Retainer & Refund Policy

• All package prices are refundable retainers, not service fees.

• The retainer is fully refunded within 24 hours of closing, provided the purchase is completed with Next Fit LLC as your Buyer’s Agent.

• If you purchase a property without us, your package is considered a paid consultation and coaching service, and no refund will apply.

• Refunds come from splitting the seller’s commission, ensuring full transparency.

4. Due Diligence & Additional Costs

• Buyers are responsible for costs related to:

  • Technical inspections

  • Legal reviews

  • Notary/title company services

  • Government fees & taxes

• Level 1 legal investigation is included in all packages. Level 2 investigations (highly recommended) are optional and billed separately.

5. Travel & Visit Policy

• Travel and accommodation costs are not included, except:

  • Ground transportation for property visits is included in the Gold Package.

  • Special "Fly & Buy" promotions may reimburse up to $2,000 USD per couple for flights on qualifying purchases (property price above $450,000 USD, when the promotion is active).

• Visits must be scheduled in advance and fall within the package’s active period.

6. Funds Handling Compliance

• All payments to the seller (direct or via escrow/title) must originate from an account in the buyer’s name.

• This ensures compliance with anti–money laundering regulations and protects your capital gains tax position for future resale.

7. Confidentiality

• All client information, property preferences, and transaction details are treated as strictly confidential and handled under our Privacy Policy.

8. Governing Law

• These Terms & Conditions are governed by the laws of the country where the property is purchased (Mexico, U.S., or Canada), with applicable international compliance standards.
