12.4 Terms & Conditions of Service

These Terms & Conditions govern your use of Mystard’s Buyer’s Agent services and apply once you engage with our team via a service agreement.


1. Scope of Services

Mystard provides buyer-focused real estate consulting including:

  • Discovery interviews and buyer profiling

  • Market research and property shortlisting

  • Coordination of property visits

  • Legal and negotiation support

  • Fideicomiso and Notary closing guidance

All services are subject to the selected package (Silver or Gold) and its included deliverables.


2. Validity Period

Each package has a validity period:

  • Silver Package: 4 weeks

  • Gold Package: 10 weeks

The timeline begins on Day 0, defined as the day the curated property proposals are presented. No further services are due beyond the package window unless an extension is purchased.


3. Refund Policy

Refunds are guaranteed if:

  • The client closes on a property during the package window

  • The transaction is completed via Notary

  • Payment to the seller has been verified

Refunds are processed within 24 hours. If no transaction occurs, the payment is considered a non-refundable service fee.


4. Client Responsibilities

Clients agree to:

  • Provide honest and timely communication

  • Attend scheduled interviews and visits

  • Respect the agreed package limitations

  • Pay for third-party services (due diligence, Notary, inspections, etc.) as needed


Mystard is not responsible for:

  • Financing decisions made by banks or lenders

  • Delays caused by third parties (Notaries, sellers, developers)

  • Outcomes of legal disputes between buyer and external entities


6. Jurisdiction

This agreement is governed by the laws of Quintana Roo, Mexico. Any dispute shall be settled in local courts, unless otherwise agreed in writing.
